Terms of Service

By downloading, installing, or using the FEEDBACK application (“App”) or accessing the feedbackcoach.app website (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms form a legally binding agreement between you and Ryan Dowling Counihan (“we”, “us”, or “our”), the sole trader operating FEEDBACK at feedbackcoach.app.

FEEDBACK is an adaptive HYROX training platform that helps athletes log training sessions, receive personalised weekly training plans, and monitor training load through a diagnosis engine. The App optionally integrates with Apple HealthKit to incorporate biometric data into training recommendations.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice where possible.

To use FEEDBACK you must:

• Be at least 13 years of age (or 16 years of age if you are in the EU/EEA)
• Have the legal capacity to enter into a binding agreement
• Provide accurate and truthful information when creating your account

If you are between 13 and 18 (or the applicable age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

• You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at privacy@feedbackcoach.app if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

FEEDBACK may offer paid subscription plans through Apple In-App Purchase. The following terms apply to all subscriptions:

• All billing, payment processing, and subscription management is handled exclusively by Apple through the App Store. We do not collect or store your payment information.
• Subscription fees are charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• To manage or cancel your subscription, go to App Store → your Apple ID → Subscriptions.
• Refunds are governed by Apple’s refund policy. We are unable to issue refunds directly — please contact Apple Support for refund requests.
• Prices may change with prior notice. Continued use of the Service after a price change constitutes acceptance of the new price.

Apple’s standard End User Licence Agreement (EULA) also applies to your use of the App: Apple Standard EULA.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to reverse engineer, decompile, or disassemble any part of the App or Service
• Access or attempt to access other users’ accounts or data
• Use HealthKit data obtained through the App for any purpose other than improving your own training within FEEDBACK
• Transmit any malware, viruses, or other harmful code
• Misrepresent your identity or provide false information
• Scrape, crawl, or otherwise extract data from the Service by automated means

All content, features, algorithms, user interface designs, logos, and software comprising the FEEDBACK App and Service are owned by Ryan Dowling Counihan and are protected by copyright, intellectual property, and other applicable laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service solely for your personal, non-commercial training purposes as permitted by these Terms.

Your training data and session logs remain yours. You grant us a limited licence to store and process your data solely to provide the Service to you.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee any specific training outcome or athletic improvement from using the App.

Biometric data from Apple HealthKit is used as a signal to inform recommendations — it is not a clinical measurement and may not accurately reflect your physiological state.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RYAN DOWLING COUNIHAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid for the Service in the twelve months preceding the claim, or (b) €100.

Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

If you are a consumer in the EU/EEA or UK, you may have additional statutory rights that these Terms do not affect.

You may stop using the Service and request account deletion at any time by contacting us at privacy@feedbackcoach.app.

We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation. Upon termination, your right to use the Service ceases. Data deletion will follow the process described in our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of Ireland. If you are a consumer in the EU, you may also benefit from any mandatory consumer protection provisions of the law of your country of residence.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved informally by contacting us at privacy@feedbackcoach.app. If we cannot resolve the dispute informally, it shall be subject to the exclusive jurisdiction of the courts of Ireland, except where mandatory consumer law in your country requires otherwise.

EU consumers may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

We may revise these Terms at any time. The effective date at the top of this page reflects the latest update. We will notify you of material changes via the App or by email. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
